Our Criminal investigation code, inspired by Napoleon, was promulgated in 1835, in the 19th century and underwent no major changes in 180 years. The provisions contained in this Code, in addition to their obsolescence, do not allow the fundamental rights of citizens to be fully respected within the framework of the guarantees enshrined in the Constitution and the international conventions ratified by the Haitian State.

This explains why the revision of this code is necessary, for this purpose President Jovenel Moise and the Government Lafontant adopted, in the Council of Ministers, the "draft law on the code of penal procedure" with a view to providing response to the main dysfunctions of the current penal justice system. The bill, which is the fruit of the work of the Joint Technical Committee on the Elaboration of the new Penal Code and of Code of Criminal procedure, this bill takes into account the concern for the respect of the fundamental rights of the individual and the protection of the society.
