Haiti - FLASH : France accused of racism and xenophobia towards the Haitians of Guadeloupe
In an open letter addressed to the French authorities of Guadeloupe, the Association "Tèt Kole" member of the Federation of French-Haitian Associations of Guadeloupe and Collectif Haiti de France, denounce the lack of respect for the human rights of the Haitian community living in French overseas territories, particularly in Guadeloupe, under discriminatory decisions, since they only concern Haitians.

Extract of the open letter to the French authorities :

"[...] Association 'Tèt Kole' member of the Federation of Franco-Haitian Associations of Guadeloupe and the Collective Haiti of France informs you of the more than worrying situation of Haitians living in Guadeloupe.

[...] we note for some time, that the Haitian population of Guadeloupe is victim of more and more of non-respect of human rights [...] fed by the contempt of some public administrations.

To illustrate our point, we recently learned that to fight against the circulation of false administrative documents, the Ministry of Europe and Foreign Affairs would have recommended to the sub-prefecture to no longer take into account the extracts of birth already legalized by three public institutions in Haiti (Procuratorate, Ministry of Justice, Ministry of Foreign Affairs) in addition to the Consulate General of Haiti in Guadeloupe which confirms their legality.

Now these documents must be legalized by the Embassy of France in Haiti for all the procedures concerning : the first applications for a residence permit and in some cases renewal. A recommendation transformed into an obligation by the sub-prefecture. Such a decision is more than restrictive and extremely discriminatory because it concerns only Haitians living in Guadeloupe.

The embassy claims 25 euros per legal extract. In addition to the additional costs imposed on families in precarious situations, there is also a list of documents that are very difficult to obtain in Haiti in a timely manner :

- Copy of the identity document of the applicant.
- Copy of the identity document of the applicant in France.
- Proof of proof of residence in France of less than one year.
- Courrier of the authority having requested the legalization.
- Letter from the plaintiff in France giving power of attorney to the depositor to carry out the steps of legalization with our services.
- Legalized signature at the town hall of your home.

In fact, this decision qualifies all Haitians in Guadeloupe without distinction of counterfeiters. She's also humiliating.

It seems to us that the Consulate of Haiti has full competence for the legalization of these documents. By taking such an unfair measure, the Ministry of Europe and the sub-prefecture are putting a further brake on the community's desire to integrate.

[...] In addition, the sub-prefecture refuses to give the mail required by the Embassy of France to users, in all likelihood it is not even aware of the list of documents required for legalization. However, this list was sent to them by the associations to alert them to the difficulties caused.

[...] Moreover this decision also surprised the Haitian consulate in Guadeloupe, which is left with hundreds of archive extracts under the arms or already delivered without the legalization required by the sub-prefecture, consequently, hundreds of families are still penalized because they have to pay again to return the extracts to Haiti by their own means [...]

[...] This decision is only another disguised thorn at the feet of the Haitians of Guadeloupe. As a reminder, our people are daily victims of racism and xenophobia and we would like to be treated differently by the French public service.

[...] Some agents of the police, and the PAF (police of the air and the borders) without fear of being worried grant themselves the right to launch racist and xenophobic remarks regularly against the Haitian originates.

Obligations to leave the territory (OQTF) are signed in turn by the sub-prefecture of Pointe-à-Pitre for people who have been living illegally for 10, 15, 20 years and more in the territory because they can not regularize their situation.

[...]

These OQTFs are often full of inaccuracies about the actual situation. In the absence of consideration, most families spend a fortune, up to 3,000 euros in legal fees for recourse to the administrative court. In the vast majority of cases these remedies are won by the litigants which shows the lightness with which they were treated by the administration.

[...] Another example, residence permits are issued by the sub-prefecture with two or three months of validity, or even outright expired.

This is only a brief record of the administrative abuses suffered by the Haitian population of Guadeloupe. These practices do not honor France, country of the human rights and the citizen. [...]"
