The past week, President Jovenel Moïse in the Council of Ministers headed by Prime Minister a.i. Jean Michel Lapin, issued a decree published in the official journal "Le Moniteur" which "determines the markets relevant to defense or national security".

This decree replaces the Decree of January 9, 2019 revising that of August 30, 2017, which set the procedural rules for the award of certain works contracts, of supplies, of intellectual prestations and services in the fields of defense or national security.

In this Order of 19 articles, Article 2 mentions "the markets relating to defense or national security" and lists many fields and aspects "considered as markets relating to defense or national security" including "electricity".

As the list is not exhaustive, Article 2 stipulates in its last paragraph that this also includes all "The markets relating to the fields which contribute to the stability and development of the Nation and the values ​​which underpin it or to general well-being of the population, approved by resolution of the Council of Ministers."

Numerous articles of this Order allow President Moïse to enter into agreements, among others, by mutual agreement, in a restricted call for tenders, etc... locally, internationally, and with other States by freeing themselves in the name of "National Security" many constraints and limitations : legal, public procurement and international agreements not ratified by parliamentarians, outside of any control of the Parliament became dysfunctional since January 13, 2020.
