Haiti - Jacmel : Reinforced measures and strong sanctions in the fight against Covid-19
Considering that the latest statistical data shows that several people tested positive for Covid-19 are in the Arrondissement of Jacmel, that there is an urgent need to act to limit any possible loss of human life by relying on the precautionary principle ; on the report of the Government Commissioner, the Southeast Delegation, the National Police of the Southeast, the opinion of the public and civil protection and after deliberation in Municipal Council, Marky Kessa the Mayor of Jacmel published on April the Municipal Decree "COVID-19, NO 1"

Text of the municipal decree :

"Article 1.- The purpose of this municipal decree is to fix and strengthen the various provisions contained in the Presidential decree of March 19, 2020 in relation to the standards and measures proposed by the World Health Organization (WHO).

Article 2.- Upon publication of this order, drivers on the Jacmel-Port au Prince route must place two passengers per row. Drivers and passengers must wear their mask or they will be penalized.

In the event of non-compliance with these provisions, the faulty drivers will pay a fine of ten miles (10,000.00) Gourdes. In the event of a repeat offense, the vehicles of these drivers will be confiscated by the Police until further notice and the fine will be doubled.

Article 2.1.- For the inter-urban journey of the Jacmel district (Jacmel, Cayes-Jacmel, Marigot and La Vallée de Jacmel), there must be no more than eight (8) passengers. Drivers and passengers should wear their mask to protect each other.

In the event of violation of these provisions, drivers will be penalized (see article 2).

Article 3.- Only trucks transporting food products and building materials are authorized to make the journey from Jacmel to Port au Prince, for users must be provided with their mask under penalty of being sanctioned (see article 2).

Article 4.- There can only be a maximum of two people on motorcycles and users must wear their mask. Otherwise, the driver and the passenger led will each pay five hundred Gourdes (500.00).

In the event of a repeat offense, the motorcycle will be confiscated and the fine will be ten thousand (10,000.00) Gourdes.

Article 5.- The owners and managers of bars, resto-bars, restaurants, supermarkets, shops will open their doors from six (6) am until seven (7) pm by regularly disinfecting the premises during daylight hours. Employees and managers must wear their masks.

In case of violation of these measures, the culprits at fault will pay a fine of fifty miles (50,000.00) Gourdes and in the event of a repeat offense, the managers of these companies will pay a fine of seventy-five miles (75,000.00) Gourdes and the companies concerned will be there subject of the affixing of seals.

Article 6.- Games of chance, brothels, gagères and all other activities facilitating the gathering of people are formally prohibited with the exception of the borlette. Violators of these provisions will be arrested and will pay a fine of fifty thousand (50,000.00) Gourdes.

Only hospitals, health centers and clinics designed for this purpose are authorized to receive the sick and provide them with the necessary care. Any violator of these provisions will be arrested and will pay a fine of one hundred miles (100,000.00) Gourdes,

Article 7.- Mondays, Tuesdays, Thursdays and Saturdays, public markets will be open for food products. Wednesdays, public markets will be open for other products. Fridays and Sundays the public markets will be closed.

In case of violation of these provisions the goods will be confiscated and the offenders will pay a fine of five thousand (5,000.00) Gourdes to be able to recover them. But if the products are perishable and perishable, the authorities incur no responsibility.

Article 8.- Rara bands are formally prohibited from performing under penalty of being sanctioned. Those responsible will be arrested and will pay a fine of fifty miles (50,000.00 Gourdes).

Article 9.- In accordance with the Presidential decree of March 19, 2020, the curfew over the entire national territory from 8:00 p.m. to 5:00 a.m. In case of violation, offenders will be punished:

a) The owners of motorcycles will pay a fine of five miles (5,000.00) Gourdes.
b) Vehicle owners will pay a fine of twenty-five miles (25,000.00) Gourdes
vs. The merchants of frying (fritay), corn and others, will pay a fine of five miles (5,000.00) Gourdes and their goods will be seized.
d. Persons not authorized to circulate will be arrested and will pay a fine of five cents (500.00) Gourdes.

Without their identity card, they will pay a fine of five thousand (5,000.00) Gourdes and spend two (2) days in prison.

Article 10.- Children from 3 to 17 years old are obliged to stay at home, in accordance with the closing of classes.

Article 11.- From now on, all road users are required to wear their masks to protect themselves and others by the precautionary principle.

Article 12.- Law enforcement officers are authorized to use the constraint necessary to overcome the resistance of all those who refuse to submit to the prescriptions of this municipal decree.

Given and published at the town hall, this Monday six (6) April 2020 in 161 year of independence so that no one pretends to be ignorant.
