Haiti - FLASH : Summary of the preliminary draft of the new Constitution (official)
Friday the Independent Advisory Committee (ICC) after a month of consultations, arrived at the preliminary draft Constitution thanks to the contributions of dozens of national and international experts, of which it presented a summary and outlines.

This preliminary draft Constitution will now be submitted for consultation to the sectors of civil society, communities, religions, private sector, associations, diaspora etc... in order to collect their reactions and proposals.

At the same time, departmental meetings will be held throughout the territory.

This preliminary project devotes more than two months of work, research and listening to dozens of national and international experts. It faithfully reflects our demands and those of nearly 87% of Haitians who want a new Constitution: a text allowing us to get out of the spiral of instability, to have more efficient and more economical public management," said Boniface Alexandre, President of the ICC.

This preliminary draft establishes the transition from a parliamentary regime to a balanced presidential regime where the President of the Republic and the Parliament will be brought to collaborate while controlling each other.

The ICC has placed the democratic principle as well as the strengthening of the rights and duties of citizens at the heart of its concerns. Thus, it was decided to put forward constitutional rights and freedoms in another introductory article, as well as the reaffirmation of the inclusion in the preamble of the constitutional text of "inalienable and imprescriptible rights to life, liberty and pursuit of happiness, "within the framework of a socially just, economically free and politically independent Haitian nation".

Thus, the project proposes in particular that the President of the Republic, always elected for 5 years by direct universal suffrage within the limit of two consecutive mandates, lead the government, supported by a vice-president elected on the American model. Regarding the Parliament, now composed of a single chamber, it is also recommended that it have the power of control over the Government and participate in the appointments of officials of constituted institutions such as the Constitutional Court or the new Superior Council of Judicial power, so that the legislative power can balance the executive power more effectively.

Another major advance in the draft of the new Mother Law: the Constitution will take into account the members of the diaspora (3 million people and nearly 40% of Haiti's economic weight in the political life of the country. The diaspora would henceforth be represented in the National Assembly and could benefit from dual nationality. According to sociologist Louis-Naud Pierre, member of the ICC : "this is a historic moment for Haiti, which can regain nearly a quarter of its population and thereby the feeling of a true community with a national destiny".

The Citizen Protection Office is made permanent, the Superior Court of Auditors is modernized, the Permanent Electoral Council will have increased powers, while a real Constitutional Court is created.
