The downloadable draft Constitution which is submitted for discussion to citizens, organized groups and civil society figures, between February 2 and 22, 2021 was prepared by the Independent Advisory Committee set up under the Decree of October 28, 2020.

Methodology :

The Committee drew on the reports of the various consultations carried out between 2007 and 2020 concerning the 1987 Constitution. Among these reports, the main ones are: the Moïse / Hector Report (2007); the Report of the Working Group on the Constitution (2009); the Report of the Special Commission for the Amendment of the Constitution of 1987 of the Chamber of Deputies (2018); the Report of the nation's sectoral States General (2019); the Report of the Office for the Protection of the Citizen (2020). One should also note works on the Constitution of 1987, such as: The Amendment of the Constitution of 1987: Issues, Limits and Perspectives, edited by Fritz Dorvilier (2012); Advocacy for a new Constitution by Mirlande Manigat (1995); A constitution in turmoil: The new Haitian political regime and the national crisis, 1987-1993 by Claude Moïse (1994).

To this work are added dozens of newspaper articles and books focusing on critical points of the 1987 Constitution. The main ones are: the Superior Court of Accounts and Administrative Litigation, the amendment, the electoral system, political parties, discharge, independent institutions, nationality, referendum.

This documentary approach is supplemented by the hearing of more than thirty national and international experts in the three main areas covered by the Constitution: a) the political system; b) decentralization; c) the exercise of fundamental rights, sovereignty and citizenship. These auditions take place in November-December 2020.
