Haiti - Assassination of Jovenel Moïse : What says the Constitution ?
Following the assassination of President Jovenel Moïse on Wednesday July 7 around 1:00 a.m. at his residence in Pelerin 5 https://www.haitilibre.com/en/news-34162-haiti-flash-president-jovenel-moise-assassinated-by-mercenaries-official-updated-7am-+-video.html , many are wondering who will lead the country.

Article 149 of the 1987 Constitution amended in 2011 states :

Article 149 : "In the event of the vacancy of the Presidency of the Republic either by resignation, dismissal or in the event of duly established permanent physical or mental incapacity, the Council of Ministers, under the Presidency of the Prime Minister, exercises the Executive Power until the election of another President.

In this case, the ballot for the election of the new President of the Republic for the time remaining to run takes place at least sixty (60) days and one hundred and twenty (120) days at most after the opening of the vacancy, in accordance with to the Constitution and the electoral law. In the event that the vacancy occurs from the fourth year of the presidential mandate, the National Assembly meets automatically within sixty (60) days following the vacancy to elect a new Provisional President of the Republic for the time which remains to run."


Let's remember that the 1987 Constitution before amendment Article 149 had a different mechanism for replacing the President :

Article 149 : "In the event of the vacancy of the Presidency of the Republic for any reason whatsoever, the President of the Court of Cassation of the Republic or, in his absence, the Vice-President of this Court or in the absence thereof, the oldest judge and so on in order of seniority, is provisionally invested with the function of President of the Republic by the National Assembly duly convened by the Prime Minister [...]"
