Haiti - Politic : Details on risk compensation for PNH agents engaged in special operations 22/07/2022 10:52:39 Summary of the decree: "[...] In the event of injury, the agent continues to receive his salary for the duration of his temporary incapacity. However, the duration of this temporary incapacity shall not exceed twelve (12) months. If the damage incurred results in permanent physical incapacity, the staff member victim, in addition to the special risk allowance, will receive a disability allowance equivalent to his salary, until his pension is paid. "[...] Article 3 stipulates that the agent who is the victim will be entitled to special risk compensation, the quantum of which is thus fixed "Agent 1, 2, 3, and 4 : 500,000 gourdes; inspectors : 750,000 gourdes and commissioners : 1 million gourdes [...] The cases of the highest ranking officers will be subject to special considerations [...] "[...] When a major accident results in the death of the agent, a death benefit will be paid to his/her surviving spouse, his/her notorious concubine duly registered in the certificate of declaration of notorious concubinage and to his minor children; failing this, all the beneficiaries of the order of succession provided for in the Civil Code. "[...] "Agent 1, 2 and 3: 1 million Gourdes; Inspectors: 1.5 million gourdes; Commissioners: 2 million gourdes. The cases of the highest ranking officers will be the subject of a special study [...]" "[...] In the event of death in a police operation, a dignified funeral will be given to the police officers. The transport of the remains from the place of death to the place of burial and the funeral expenses will be borne by the State without exceeding two hundred thousand gourdes "[...] On the report of the Commander in charge of the mission, the circumstances of the death or disappearance of an agent engaged in a police operation are determined by joint and prompt investigation of the General Inspectorate and the Central Management of the Judicial Police (DCPJ). The General Inspectorate expressly instructs the Central Administration and General Services Department (DCASG) to take charge of the file, which will be sent to the Ministry of Economy and Finance (MEF) for validation and payment." This decree, which responds to the demands of the Police officers and Police Unions who demanded better treatment in the exercise of their functions, is available in a 4-page document, containing 3 chapters and 10 articles. This decision of the Government responds to "the imperative duty of the State to offer to PNH agents who have made sacrifices for the community and also to their dependents guarantees of rights and social benefits related to the risks incurred."
