Haiti - FLASH : The TNH no longer has the right to broadcast the Qatar 2022 World Cup for the moment
While the Ministry of Communication in a press release had informed the population that the matches of the 22nd Football World Cup (November 20 to December 18, 2022) would be broadcast by the National Television of Haiti (TNH) and thanked the President of FIFA, Gianni Infantino for agreeing to grant free of charge, the broadcasting rights to Haiti https://www.icihaiti.com/en/news-38173-icihaiti-flash-the-tnh-obtains-free-tv-broadcasting-rights-for-the-qatar-2022-football-world-cup.html , it turns out that in fact the TNH was only authorized graciously to broadcast that "[...] the matches of the first two days and that in order to continue to receive the stream, the rights fee had to be paid [...]" as indicated in the press release of "Verticast Media Group Ltd." which acts as the only entity responsible for the exploitation of media rights in Haiti (rights confirmed by a letter from FIFA, two documents that we reproduce below. What knew yet the Minister of Culture and Communication informed by correspondence from "Verticast Media Group Ltd."

Verticast Media Group Ltd. specifies that given the non-payment of rights] "[...] the TNH will not be authorized to broadcast matches of the FIFA World Cup Qatar 2022TM from November 30, 2022" while stressing that they are "[...] ready to work with TNH to ensure access to all FIFA World Cup matches."

The FIFA World Cup Qatar 2022TM kicked off on Sunday, November 20 and the National Television of Haiti (TNH) broadcast the matches until Monday, November 29 live after obtaining authorization from FIFA, DirecTV and VertiCast Media. This authorization was granted without TNH fulfilling its contractual obligations.

Following the negotiations and signing of the agreement with TNH to broadcast the FIFA World Cup and since the start of the FTFA World Cup, TNH has had multiple opportunities to pay the broadcast rights but does not did not. As a result, TNH will not be allowed to broadcast matches of the FIFA World Cup Qatar 2022TM from today, starting November 30, 2022. This also means that due to the fact that TNH is not licensed, no other broadcaster in Haiti can show FIFA World Cup matches. Anything that will not violate the broadcast rights.

On Sunday, November 20, 2022 before kick-off, in the best interest of all in Haiti, VertiCast has temporarily authorized access to TNH to broadcast live matches from the FIFA World Cup. Fifa.

To date, FIFA or the Government of Haiti have not provided any document confirming any arrangement to allow Haiti free access to the FIFA World Cup Qatar 2022™ or modifying the conditions contractual.

In a letter to the Minister of Culture and Communication (MCC), it was indicated that the TNH would be authorized to broadcast the matches of the first two match days and that in order to continue to receive the stream, the license fee duties has to be paid. Although no payment was received, TNH was granted uninterrupted access to the stream and another payment attempt was made, this time requesting payment by November 28. At the time of this press release, no payments have been made by TNH or MCC.

This means that the TNH will not be allowed to broadcast the matches live and unfortunately many in Haiti will not have access to the FIFA matches for the second round of the competition. As a result, no broadcaster in Haiti is licensed to broadcast FIFA World Cup matches as TNH has not been licensed by FIFA, Direc1V or VertiCast as the broadcast rights holder. .

VertiCast is ready to work with TNH to ensure access to all FIFA World Cup matches."

"TO WHOM IT MAY CONCERN

Doha, 18 November 2022

CONFIRMATION OF RIGHTS

Fédération Internationale de Football Association of FIFA-Strasse 20, 8044, Zurich, Switzeland ("FIFA") is the international governing body of the sport of association football ad has the exclusive right to :

(i) sanction ans stage the FIFA World Cup Qatar 2022™ (the "Event"); and

(ii)licence all broadcast rights to such Event by any and all means.

In respct of the territory of Haiti, FIFA confirms that, subjects to the termes of an angreement dated 5 December 2014 between FIFA and DirecTV Latin America, LLC ("DirecTV"):

(i) it has licencied to DirecTV the right to broadcast the Event (on a live, delayed and repeat basis);

(ii) it has, in respect of teh Event, licensed to DirecTV exclusive television rights, mobile transmission rights, IPTV transmission rights and broadband transmission rights as well as non-exclusive radio rights (collectively the "Media Right"); and

(iii) DirecTV is permitted ro sub-license the Media Rights (or ant part thereof).

Further, FIFA confirms that it has expressly authorised DirecTV's sub-license of certain free-to-air Media Rights for the territory of Haiti to Verticast Media Group Ltd. (VMH), 1 Bourbon Streeet, Bourmon House, Castris, St. Lucia "Verticast", where Verticast accts as the sole entity responsible for the exploitation of such free-to-air Media Rights in Haiti.
