Haiti - FLASH : Biden proposes very harsh legislation for asylum seekers at the border
On Tuesday, February 21, the Biden administration proposed that new restrictions be applied to asylum seekers, in order to prevent an influx of migrants at its southern border with Mexico, once the application of Title 42 (which is part of of the Public Health Act 1944 which authorizes the temporary expulsion of aliens for health reasons).

This new legislation jointly developed by the US Departments of National Security and Justice will make it very difficult to seek asylum for tens of thousands of migrants stranded at the southern border, and will facilitate the deportation of people who cross the border and seek asylum from the Government after...

The proposed legislation establishes “a rebuttable presumption of ineligibility for asylum” for anyone crossing from another country to reach the US border with Mexico without first seeking protection there. However, exceptions are made for people with an “acute medical emergency” “imminent and extreme threat of violent crime” or “other extremely urgent circumstances”.

The new rules would require migrants to apply for asylum online, through the official CBP One app or to seek asylum in a country they cross to arrive at the US border, otherwise they will not be able to claim at the asylum.

Sources at the White House explained on Tuesday that these regulations are intended to "fill the legal void" that will be left after the possible end of the application of "Title 42" on May 11 with the end of the pandemic, this which could trigger an unprecedented crisis on the southern border. The Biden administration explains that in the absence of action from Congress, this is the only way to manage the border, because every month up to 200,000 people try to cross the border, most asking asylum.

This new legislation should be put in place once the withdrawal of "Title 42" scheduled for May 11 if it is not challenged in court.
