Haiti - Justice : Disagreement on the list of candidates to the Court of Cassation
The Senator Youri Latortue, President of the Commission Justice and Security of the Senate has indicated that the list of candidates for judges of the Court of Cassation had been returned by the President for non-compliance. Although the Senator Latortue said he had no doubt about the willingness of the Head of State to proceed with the implementation of the Supreme Council of Judicial Power (CSPJ), he notes that at 10 days of the new legal year, the vacuum persists and the case drags.... However, the Senator remains confident that even if the date of October 3 is not met, the President will proceed to the implementation of CSPJ

"...I took information within the presidency, they told me that the presidency had turned the list [of 18 candidates], and that the criteria were not respected, namely that the person must have been a judge of the Court of Appeals for seven years or that it has been active as a lawyer for ten years [...] as soon as the office of the Senate received the list, it rechecked the criteria according to the records and found that the names that we have given meet these two criteria [...]

However, if he [the Head of State] finds that a person has used false, or something else, as he has the choice and that he must choose 6 out of 18, he will not consider that person and will put the prosecution in motion, the President is the guarantor of the institutions.

[...] we believe that the Senate office has no other choice that to remind to the Presidency that the criteria are met. [...] not only we have submitted a list of 18 personalities, but we have submitted him three names per seat: name, date, time spent at the court of appeal, its current position and in general, the number of years that it did in the magistracy. [...] This are information that they [the candidates] gave us when we made the call for applications..."


For his part, the President Martelly said Sunday on his return from New York, concerning the judges "long ago we sent a list of proposals to Parliament, it sent back a counterproposal. We made an analysis of the whole list and it was good to review it with them, because we believe that there are names that should not be on this list. Here is where we are, we are working, I even made ​​an announcement to say that by October 3 it is necessary to end with this casen it is because we move forward on it, that I tell you that..."
