Haiti - Cap-Haitien : Valorization of heritage and transfer of management to the private sector (Order)
As part of the permanent commitment of the Municipal Commission to the improvement of the urban environment, the Town Hall of Cap-Haitien published an order on the valorization of heritage (historical and natural) and the transfer of management to the private sector of public markets, cemeteries and bus stations aimed at promoting the well-being and development of the municipality.

This decree represents a significant step towards the preservation and enhancement of historical and natural heritage. It aims to promote the conservation of forts, monuments and public squares, as well as the responsible management of public beaches and natural sites. In addition, this decree provides for the transfer of the management of public markets, public cemeteries and bus stations to private companies, with the aim of improving their efficiency and operation.

Municipal Order:

Article 1- The Municipal Council launches, following this decree, a restricted call for tenders for the purpose of recruiting Firms responsible for ensuring the complete management of public contracts, bus stations, cemeteries and historic sites and natural.

Article 2- The management of each market, each bus station, each cemetery, each historical and natural site will be ensured either by the Municipality or by a separate Company. However, the same Firm can manage two (2) Services, depending on its duly justified human resources and logistics capacity.

Article 3- As part of the transfer of management of Markets, Bus Stations, Cemeteries and Historical and Natural Sites, the selected firm will be called "service provider" and the Town Hall "project owner". The two (2) parties will be bound by a renewable contract, depending on the performance of the results.

Article 4- For the management of historic and natural sites. a consortium composed of the Town Hall, the Ministry of the Environment/ ANAP, the Ministry of Culture/ ISPAN and the Ministry of Tourism will be set up either for direct management or for transfer to Firms.

Article 5- Any person occupying a space in the area defined and developed for the markets must be provided with an authorization card for this purpose, resulting from the payment of an occupation fee for the space.

Article 6- Cleaning taxes are collected from each trader, small, medium or large, and each entrepreneur occupying space in the market area. Action will be taken against any offenders. If it is a trader, his goods will be seized and returned only after payment of taxes. If it is an entrepreneur with a shop or store, seals will be affixed and will only be lifted after payment of the corresponding taxes.

Article 7- Supervision and control of the service provider's activities will be ensured by the Project Owner (the Town Hall), in the field and during monthly evaluation meetings accompanied by reports.

Article 8- Concerning the management of bus stations, a mixed commission will be formed between representatives of the Town Hall, owners' and transporters' unions and the selected Firms.

Article 9- A contract will specify the rights and responsibilities of each party.

Article 10- For everything relating to historical and natural sites, a partnership between the Town Hall, the Ministry of the Environment/ANAP, the Ministry of Culture/ISPAN and the Ministry of Tourism is obligatory.

The Municipal Commission is committed to implementing this decree proactively, in collaboration with the various stakeholders concerned, in order to guarantee its success and its positive impact on the quality of life of the Municipality.
