Haiti - Politic : Position of the Presidency on the decision of Judge Carvès

Given the numerous reactions disapproving the decision of investigating judge Jean Carvès in charge of the case of former dictator Jean-Claude Duvalier, who in its Closing Order recommends the referral of Jean Claude Duvalier before a criminal court for misappropriation of public funds, but not for violations of human rights; before the allegation and rumors, that points of the finger the "hand" of the Presidency in the decision, the Presidency of the Republic wanted to clarify by press release dated February 3, 2012 :

"Given the order of the investigating judge handling the case of former President Jean-Claude Duvalier, the Presidency of the Republic wishes to clarify that:

- That decision rests solely with the Haitian justice. Justice must take its course.

- The Presidency of the Republic respects the judicial decisions and has no right to interfere in the cases within the judiciary which is independent.

- The Presidency of the Republic remains committed to work to the establishment and the triumph of the rule of law in Haiti. To this end, it even requested the technical assistance from the international community to strengthen the judicial system and sensitize the magistrates on human rights issues."
