Haiti - FLASH : Denial of the Prime Minister's Ofice

The Communication Office of the Prime Minister's Ofice makes a formal denial concerning the misinformation circulating that suggest that the Prime Minister Laurent Lamothe, would have been involved in the abrogation of Article 297 of the Constitution of 1987.

The Communication Office of the Prime Minister's Ofice reminded the public and all sectors interested by the issue, that the prerogative of constitutional amendments is sole responsibility of the Legislative Body and therefore falls outside the authority of the executive who can not, under any circumstances, interfere.

The Communication Office of the Prime Minister's Ofice counts on the understanding of everyone and take this opportunity to recall that the republican principles of the separation of state powers, are the foundation of the Haitian democracy.

Constitution 1987 (before amendment)

Article 297 :

All laws, all decree laws, all decrees arbitrarily limiting the basic rights and freedoms of citizens including :

a) The Decree-Law of 5 September 1935 on superstitious beliefs ;

b) The Law of August 2, 1977 establishing the Court of State Security ;

c) LThe Law of July 28, 1975 placing the lands of the Artibonite Valley in an exceptional status ;

d) The Law of April 29, 1969 condemning any doctrine of importation ;

Are and remain abrogated.

Constitution 1987 amended :

Article 297 of the Constitution of 1987 is abrogated.
