Haiti - Politic : Message to the Nation of President Martelly
The President Michel Martelly, has issued this Monday, August 20, 2012, at 9pm, a message to the Nation where he explained his decision to establish the Permanent Electoral Council, recalling in introduction, that "August 21 is an important date in the nation's history. It marks the general uprising of slaves, uprising that led to the national independence. This is a date of rupture..."

MESSAGE to the Nation of President Michel Martelly :

"Haitian people,

August 21 is an important date in the nation's history. It marks the general uprising of slaves, uprising that led to the national independence. This is a date of rupture.

This August 21, 2012, 221 years later, we set a founding act in the construction of a Democratic Rule of Law. Indeed, after 16 provisional versions of the Electoral Council, despite the provisions of the Constitution, creating a Permanent Electoral Council, we are at the crossroads of history, to a date of rupture which is in our tradition of greatness, the pursuit of happiness for our people.

Form a Permanent Electoral Council (CEP) has been, since a quarter century, a major challenge for all Heads of State and of Government who have been in power since 1986. It would have been easier to continue with the tradition of provisional by using DIY solutions. But my patriotic commitment, my campaign promises and my fierce desire to work towards the establishment of a Rule of Law in a truly democratic governance prevailed over the partisan and politicians considerations of each other.

I must say that I was, repeatedly tried to imitate my predecessors by forming a 17th Provisional Electoral Council or, as some suggest, a Special Electoral Council, of Consensus, of Exception, of Transition, or even an Ultimate Electoral Council. However, these choices of continuity in the violation of the Constitution would translate an unacceptable step backwards, harmful to this Rule of Law. So I opted for the Constitution, under Article 136 of our Fundamental Charter that makes me the guarantor of democratic institutions.

It is in this spirit that I put an end to the unacceptable vacuum that persisted for 7 years at the Court of Cassation. I also formed the CSPJ under the Act of 13 November 2007, set aside for 5 years. I published the law relating to the amended Constitution, law that introduced the great innovations it contains. I have gave instructions so that the Government works to establishment of the Constitutional Council, called to strengthen the Rule of Law and address the major shortcomings of Republican Institutions.

The Electoral Council is therefore a challenge met. The electoral advisers must be themselves honorable people engaged in a battle of challenges for the respect of Law and Freedoms of everyone.

Haitian people, you voted for me because I promised you change, we are doing elections since 25 years, we always do them with a Provisional Electoral Council, while the Constitution itself requires a Permanent Electoral Council.

Many people have asked me to do this, a Provisional Electoral Council, but it would have been another violation of the mother law. Democracy goes with the elections, it is in the election that the people chooses, it chose people who will lead it.Elections for the 10 senators would already have been made, we have no magistrates nor CASEC, or delegates that the people have chosen. All these makes, that our institutions work limping. It is time, it is time that this disorder stops.

C'est pourquoi aujourd'hui, nous avons mis sur pied le Conseil Électoral Permanent, que la Constitution demande. Pendant que nous allons installer les 6 premiers membres, en attendent que la Chambre des Députés avec le Sénat, au nom du Parlement, envoient leurs 3 membres pour compléter cette institution.

We ask these six advisors to start work today to give us fair elections without fraud, in order to keep the train of the country on the rails on the Rule of Law and of the Democracy.

The Democracy is a constant conquest. It is built on a daily basis. It is a duty of every citizen to bring his stone in the construction of this building. As Head of State elected by my people, I invite all sectors of national life to play their part on behalf of the common Homeland instead of further weaken the institutions of our young democracy.

For our country, For our forefathers, United let us march, Let there be no traitors in our ranks.
