Following the vote on October 9, designating 3 new representatives of the Superior Council (CSPJ), to the Permanent Electoral Council (CEP), while the previous 3 representatives of CSPJ already installed to the CEP, refused to resign, Levaillant Louis Jeune, the President of the Lower House is convinced that the out of the crisis is at the level of President Martelly, which according to him, must withdraw the Decree of installation of 3 Representatives already members of the CEP, to allow the installation of 3 new representatives.

"[...] There are 3 members that the CSPJ had designated, everyone said they were designated outside the law, that was done improperly, but they have been installed, and they started to enjoy the privileges associated with their function, they have official cars, security and probably they already received their wages, so we get into a situation that is more complicated. It takes a lot of skill, a lot of discussion, a lot of compromise, but also a lot of wisdom to out of this situation [...]"

For the President of the Lower House it is clear that "[...] The President may return on the Decree when he wants. Similarly, if I appoint a person as resident of the House [...] I may appoint a person today and tomorrow revoke it, if I find that errors were made [...]

The CSPJ said it has made ​​a mistake, it made another choice, therefore the President has no alternative, given the new minutes, which was sent by the CSPJ, to note that the instance selected by the Constitution to choose these people, proposed 3 other people, well, the President will have to withdraw the Decree. What is a decree ? This is just an administrative act that places a person in a position...."

Except that in the situation that fueling the crisis, the example of the Deputy Levaillant can not apply, because it is not the President Martelly that named the 3 representatives but the CSPJ, and as reiterated Thursday Lucien Jura, the Spokesman of the Presidency "Any approaches of the Executive, of the Presidency that would tend to bring out the members [of CSPJ] of the Permanent Electoral Council, would be totally contrary to the Constitution and the law" [and especially to the independence of 3 powers].

In addition, the former presidential candidate, Me Jean Henri Céant continues to advocate the establishment of a Provisional Electoral Council while waiting that the Senate is complete (with all its members) disapprove the appointment of three new representatives to the Permanent Electoral Council, by the CSPJ while the Executive has not made ​​the withdrawal of the decree of installation of Representatives of CSPJ already installed [to the CEP]. He considers this new vote as "an act of rebellion against an act of the established authority" and regrets that the CSPJ has so far taken no approach with his Representatives installed, in order to obtain their resignation.
