Haiti - Justice : CSPJ strongly protests against the action of the Senators

In a note dated October 24, 2013, Me Arnel Alexis Joseph, President of the Superior Council of the Judiciary (CSPJ) strongly protest against "the intrusion of parliamentarians in the prosecution of the Court of First Instance of Port-au-Prince to remove an defendant [Me André Michel], which should be questioned according to the law [...] This behavior violates the principle of separation of powers [...] "

Recalling that the Constitution states that each power is independent of the other two, and sets limits for each intervention. "Such behavior endangers the foundations of the rule of law that every citizen requires and we are striving to build in accordance with the principle of the separation of the three powers," stating that "The response to an arrest deemed illegal, must be a habeas corpus action before the Dean or delegate judge and not a demonstration of force."

In conclusion, Me Arnel Alexis Joseph, asks Simon Dieuseul Desras, the President of the Senate and Senator Pierre Francky Exius, President of the Commission Justice and Security "to return the defendant [Me André Michel] to justice to avoid that an arrest warrant is issued against him [...]"

Me Max Elibert Max Elibert (Judge at the Court of Appeals of Les Cayes) Member of CSPJ, on behalf of two of his colleagues : Gustave Pharaon (Dean of the Court of First Instance of the Gonaives) and Dilia Lemaire (Representative of civil societye), expressed his disagreement with the contents of that note, saying that the President of CSPJ expressed a personal opinion and not that of the CSPJ...
