The businessman Réginald Boulos said he agreed with the recommendations of the Superior Council of Salaries (CSS) establishing, among others, to 350 gourdes production wages in the textile sector outsourcing for 8 hours of work explaining that it is to avoid losing our jobs if we are too expensive and to offer the worker the maximum that can offer this sector. Text of the presidential decree on the minimum wage from 1 May 2016 : "Given the Constitution, in particular Article 35 and 35.1; Given the International Covenant on Economic, Social and Cultural Rights, sanctioned by the decree of 31 January 2012; Given the Labour Code; Given the Decree of 4 November 1983 organizing the Ministry of Social Affairs; Given the Law of 10 September 2009 fixing the minimum wage payable in industrial and commercial establishments; Having regard to the Decree of 14 June 2013 establishing the Superior Council of Wages; Considering that any employee of a public or private institution has the right to a fair wage and that the State must guarantee to all workers a minimum of economic and social justice; Considering that by fixing the minimum wage the State has a duty to take into account the realities and sectoral dynamics; Considering that according to the stipulations of the Labour Code, the minimum wage must be periodically adjusted to reflect changes in the cost of living; On the report of the Minister of Social Affairs and Labour; And after deliberation by the Council of Ministers, ORDERS Article 1.- As of 1 May 2016, the minimum wage of reference is fixed at three hundred and forty and 00/100 Gourdes (340.00 HTG) for an eight (8) hours of work, for the companies of segment A indicated below : 1. Private Electricity Generation ; 2. Financial institutions (banks, transfer houses, insurance companies ); 3. Telecommunications; 4. Trade import-export; 5. Supermarkets: 6. Jewellers; 7. Art Galleries; 8. Furniture, office furniture and appliances; 9. Stores hardware; 10. Car rental companies; 11. Companies airline; 12. Companies of mail, parcel and cargo; 13. private vocational schools; 14. Companies Gambling (keepers borlette, lottery, casino, etc...); 15. Car Dealers.; 16. Communication, Advertising Agency and Media (print, electronic, radio and television) Except Community Press; 17. Private educational institutions; 18. Private academic institutions; 19. Private health institutions; 20. Funeral Services; 21. Marine and airport agencies; 22. Offices of liberal professionals and consultants; 23. Travel Agencies; 24. Estate agencies. Article 2.- As of 1 May 2016, the minimum wage of reference is fixed at two hundred eighty-five and 00/100 Gourdes (285.00 HTG) for an eight (8) hours of work, for the companies of segment B indicated below : 1. Buildings and Public Works (BTP); 2. Companies hire trucks and heavy machinery; 3. rental companies building materials; 4. Companies transporting construction materials; 5. Hardware Stores; 6. Other financial institutions (cooperatives / credit unions, microfinance institutions); 7. Wholesale Trade; 8. Stores cosmetics and clothing; 9. Retail delivery of bulk water.: 10. Companies ground transportation.; 11. Printing, photocopying, graphics, lithography and computer services; 12. Hairdressers and Massage; 13. Laundry and dry cleaning; 14. Extractive industries (mining and quarrying); 15. Companies of petrol distribution; 16. Security agencies ; 17. Manufacturing industries turned to the local market; Article 3.- As of 1 May 2016, the minimum wage of reference is fixed at two hundred sixty and 00/100 Gourdes (260.00 HTG) for an eight (8) hours of work, for the companies of segment C indicated below : 1. Hotels and restaurants; 2. Agriculture, forestry, livestock and fisheries; 3. Industries processing agricultural products; 4. Retail trade, except supermarkets, jewelery stores, cosmetics and clothing; 5. Craft shops and leather goods; 6. Companies shipping; 7. Community Press; 8. Other non-market services (non-profit organizations. Including national and international NGOs, foundations, associations, cooperatives of production and non-financial services). Article 4.- As of 1 May 2016, the minimum wage of reference is fixed at one hundred and seventy-five 00/100 Gourdes (175.00 HTG) for an eight (8) hours of work, for domestic servants (Special Class E). Article 5.- As of 1 May 2016, the minimum wage of reference is fixed at three hundred and 00/100 Gourdes (300.00 HTG) for an eight (8) hours of work, for the industrial plants exclusively focused towards re-export and mainly employing staff at the piece or task, as well as other manufacturing industries export-oriented. Article 5.1.- As of 1 May 2016, the price paid for the unit of production (including the piece, the dozen, the grosse, the meter) is set in order to allow the worker to perform for his working day of eight (8) hours at least three hundred and fifty and 00/100 Gourdes (350.00 HTG), for the industrial plants exclusively focused towards re-export (assembly export-oriented industries) and mainly employing staff at the piece or task, as well as other manufacturing industries export-oriented. Article 6.- This Order repeals all order or provision of order that are contrary and it will be printed, published and performed at the behest of the Minister of Social Affairs and Labour.
