The return to the Senate of Simon Desras Dieuseul, following a temporary order of the Court (Tribunal des référés) https://www.haitilibre.com/en/news-13165-haiti-flash-bombshell-desras-back-to-the-senate.html is not sufficient for the latter is rehabilitated in office.

Andris Riché, the Senate President recalled that the order of "tribunal des référés" being temporary, it is up to the representative of the State (DGI) to decide "it is the latter who will have to tell us if the Senator Desras was rehabilitated in office [...] But, for now, the Senate can not do anything before that decision [...]"

Thursday Desras declared "[...] I am a Senator of the Republic, until the state decides to appeal the court order of the Court, which is of course, a provisional decision [...]"

Furthermore, this return raises the question of the presidency of the Senate. Senator Riché told journalists that that he did not intend to give way to its predecessor. However, he indicated that he had requested a meeting with the Assembly of senators, to decide on the matter.

For Simon Dieuseul Desras is obvious, Riché his colleague in no case is the President of the Senate "[..] there is no legal provision. 6 senators can not elect the President of the Senate [...]" adding that his colleague knows that very well. However, Senator Desras was prepared to give up its claims, of presidency, only "If they tell me that he is there after a consensus"...
