Haiti - Elections : Non-retractable votes are not zombies votes !

In the report of the Independent Commission for Electoral Evaluation and Verification (CIEVE) released on 1st June, the PHTK notes statements that reflect a misunderstanding of the electoral system of the signatories of the report and denounced the use by the Commission of pseudoscientific artifice to legitimize its recommendations.

The PHTK states in its notes that the Commission is mistaken when it assimilates "non-retractable votes" to zombies votes, "whereas it is in fact of votes regularly expressed in accordance with Article 156 of the 2015 Electoral Decree."

Let us recall that the Commission bases its arguments of massive fraud on the concept of votes impossible to trace and wrote about it "The proportion of non-retractable (29%) applied to the total valid votes (1 560.631) means that BVs would have authorized 448,000 citizens to vote without however draw a minutes of failure, as stipulated in the Electoral Decree."

The PHTK recalls that the use of the term "minutes of failure" is an invention of the Commission, this electoral terminology is not included nor at Provisional Electoral Council (CEP) or in the Electoral Decree of 2015.

Concerning these votes non-retractable , the PHTK states that the 2015 electoral decree stipulates in Article 156 "The representaives of partiesrecognized political groups participating in elections, of cartels, of independent candidates, equipped with their accreditation card duly issued by the Provisional Electoral Council, exercise their right to vote in the office where they are assigned. Minutes is drawn", and stresses that what "The Commission calls zombies votes, in fact corresponds to the votes of representatives appointed by political parties and entitled to vote in the polling stations where they are assigned, upon presentation of the accreditation card issued by the CEP. They vote, but their names were not on the partial electoral list of the polling station. This consideration also applies to domestic observers."

The PHTK explains that "the vote of representatives in the offices where they are assigned, is a provision contained immutably in all decrees and / or electoral laws since 1990. This potential of "useful vote" is systematically used by candidates and parties since 1990. In the case of presidential elections, the number evolves according number of candidates and polling stations.

Number of "non-retractable" by elected President in Haiti :

1990 - 11 - 12,000 - 132,000 - J.B.Aristide

1995 - 3 - 11,000 - 36,000 - R. Préval

2000 - 7 - 11,000 - 77,000 - J.B.Aristide

2006 - 35 - 9,000 - 315,000 - R. Préval

2010 - 19 - 12,000 - 228,000 J. Martelly

2015 - 54 - 13,725 - 741,150 ?

(Year / number of candidates / number of polling stations / "non-retractable" / President elected)

The PHTK concluded by quoting some other beneficiaries of these votes, which are not fraudulent votes even if untraceable:

François Benoit, the current President of the Verification Commission, who was Treasurer of the 2006 CEP conducted presidential elections, dedicating the victory of René Préval with about 315,000 "non-retractable votes" without speaking of zombies votes...

Mc Donald Jean, currently a member of the Commission, was elected Senator of the Artibonite in the 1995 elections under the Lavalas Political Platform, benefiting about a thousand "non-retractable votes" cast by its representatives in more than 1,000 polling stations of department.

Jocelerme Privert was elected Senator of Nippes in 2010, benefiting from nearly 500 "non-retractable votes" cast by the representaives of the INITE platform, deployed in this department.
