Haiti - Politics : End of Personal use of State vehicles
The new Moïse-Lafontant Government intends to assert its authority and make it clear to those concerned that the period of "let do" concerning the unauthorized use of State goods for personal purposes is over. Thus, in its Order on the State Lifestyle, published in the official newspaper "Le Moniteur" #52 dated April 3, 2017, a chapter deals with the management of the fleet of automobiles, whose we share with you some important articles :

Article 3.- The purchase of any new car, pickup or off-road vehicle on behalf of the Public Administration shall not exceed the limit of two million eight hundred thousand (2,800,000.00) gourdes for those that will be registered "Service of the State" and the limit of three million two hundred thousand (3,200,000.00) gourdes for those who will be registered "Official" [...]

Group purchases and orders must be privileged and ensure of the reality of the needs expressed, and by retaining, for services, basic vehicles, excluding superfluous accessories.

Article 4.- The acquisition of new vehicles, such as cars, pickups or off-road vehicles, on behalf of any ministry, institution or public body during the period remaining for the fiscal year 2016-2017, is prohibited without Prior authorization of the Prime Minister.

Article 7. As from 1 October 2017, the use by State officials of vehicles registered as "State services" may not, except with the authorization of the supervisory authority, exceed working hours.

Article 9.- From the first of October 2017, all vehicles registered as "State Service (S.E.)" must be parked in a designated space after office hours, unless expressly authorized by the Prime Minister.

Article 10.- A geolocation system will be integrated into all vehicles registered as "State Service".

The user of a "State Service" vehicle whose geolocation system has been deteriorated or is out of use is obliged to immediately return this vehicle to the department responsible for the maintenance of the vehicles of the Ministry, the nstitution or public body concerned.

Article 11.- All vehicles in use, belonging to the State, must have their odometer in working order. Any deactivation of this control tool will be considered as serious misconduct, subject to penalties provided for.

Each vehicle registered as "State Service" must be equipped with a travel record. At the time of its use, the driver of the vehicle must sign the register of the movements of the vehicles. In this register, the object of the journey is entered, the service (or person) who requests the journey, the driver, the place of travel, the mileage when delivering the vehicle to the driver, the condition of the vehicle at departure (physical condition, fuel and oil levels, etc...), the time of departure. The driver is discharged of his obligation to guard the thing by signing the register indicating the time of return of the vehicle to its starting point, the kilometrage carried out, the levels of petrol and oil, the presence of accessories and tool kits and the overall condition of the vehicle.

Article 14.- In the case of vehicles in intensive use (police, garbage collection, public works, fire brigade, ambulance), an appropriate preventive maintenance system will be put in place. The responsible authorities of the departments concerned ensure the psychological as well as the technical capacity of the drivers of vehicles belonging to the State.

The periodic recycling of all public vehicle drivers is organized by the competent departments of the public departments and agencies.

Article 20.- The drivers of public vehicles are personally responsible for the use made of them, regardless of the instruction received from any person. Any unauthorized use of public vehicles will be punishable.
