Haiti - FLASH : The Government wants to sue the signatories of the State contract with E-Power S.A.
Following the refusal of the company E-Power S.A. to sign a new contract under the contractual commitments in force, binding the State, EDH and E-Power SA as it explains in detail in his correspondence addressed to Ministers Fritz Caillot (Public Works) and Joseph Jouthe (Economy) : https://www.haitilibre.com/en/news-29071-haiti-politic-e-power-reacts-and-reminds-the-state-of-its-contractual-commitments.html , the Government issued instructions to the Directorate General of Taxes to prosecute, in accordance with the law, the major government offcials who initialed this energy contract with the firm E-Power S.A. "in prejudice the superior interests of the Haitian State" [?], probably for the purpose of invalidating this contract [which is highly unlikely].

The signatories concerned are former ministers Frantz Verella (Public Works), Daniel Dorsainvil (Economy) and the former Director General of Electricity of Haiti (Ed'H), Serge Raphael.

Recall that in the contract of 15 years granted by the State in 2008 and in force until 2023, it is stipulated "In consideration of what is stipulated in this contract, the Haitian State and the Ed'H grant to the supplier E-Power S.A., who accepts it, the exclusive right, during the duration of the present contract, to finance, build, install and develop in the Drouillard site a thermal power station with eight (8) new groups of nominal power of at least thirty (30) MW operating on oil and owning, operating and maintaining the plant and all facilities related to the Project to enable the Supplier to make available to Ed'H under the conditions provided for in this contract the Contractual Power and Delivered Electricity".
