Haiti - Elections : The case Jean Berthold Bastien
After verification of Special National Complaints and Challenges Bureau (BCEN) the Deputy Fanèse Laguerre (Solidarite) of Vallières/Carice/Mombin crochu (North East) was elected with 60.24%, face to the candidate Jean Berthold Bastien (INITE). The Mission OAS/CARICOM observed that the petition presented in the complainant's case was not signed, which led to the decision of inadmissibility taken by the BCEN. Nevertheless, it is clear that in this case the Departmental Complaints and Challenges Bureau (BCED) exceeded the authority conferred on it by the Electoral Law by tabulating PVs that had been set aside by the CTV. As the guarantor of respect for the Electoral Law, the BCEN should have corrected this serious mistake.

Rodolphe Joazile, the President of Bureau of the senate said did not understand the decision of CEP : "...we tried to understand if indeed there is something going wrong at the CEP, so far with the list that came out I'm not satisfied. What makes that I always had a reservation on the list that the CEP had published, it is because I followed the elections in the North East [...] and I know who won his name is Jean Berthold Bastien (INITE) and everyone knows, during the election process he has always denounced a relationship between the opposing candidate [Fanèse Laguerre] and the President of the CEP, Mr. Gaillot Dorsainvil, [...] I am convinced that Jean Berthold Bastien won, when they released the first results I said to myself that indeed there was a problem, and now they have released another list and that the name of Jean Berthold Bastien is not on in, it just reinforces my position, that effectively he [Gaillot Dorsainvil] has friendly and preferred relations with Fanèse Laguerre [Solidarité], so that today we sacrifice politically Jean Berthold, someone who won the election.

Saurel Jacinthe (INITE) President of Bureau of the Chamber of Deputies wants that the CEP take necessary actions so that Jean Berthold be elected instead of Fanèse Laguerre : "I think that the case Jean Berthold, is a special case, myself as a deputy who made the 48th Legislature with him [...] as a Deputy Saurel Jacinthe I can not understand that Berthold who has lawyers who made protestations for him [...] and that today they say there is a problem of irregularity in the question Berthold.This is a case that I closely follows, I wish that the CEP take the necessary actions, if this is only that, who is reproached to the case Berthold, I think between us that they must review the case in the same way that the others who had similar problems, they have studied the case, they have verified [...] the case Berthold, must be the subject of the same concern."
