Haiti - Economy : The AmCham-Haiti worries about the proportions of the conflict between the State and the private sector
Saturday, November 29, in a note, Laurent Saint-Cyr, the President of the American Chamber of Commerce of Haiti (AmCham - Haiti), expressed concern about the proportion that the conflict between the Haitian State and certain private companies, especially those operating in the electricity sector, [notably SOGENER].

It recalls that "the principle of freedom of contract, recognized in Haitian law, gives the parties the right to freely determine the content of contracts binding them. This principle also authorizes the parties to agree beforehand on the legal methods of resolving any possible conflict relating to the said contracts."

AmCham - Haiti, without pronouncing on the substance of the dispute, invites all the parties to respect the legal provisions in this matter, in particular the respect of the Conventions which remain essential for the security of the investments.

Laurent Saint-Cyr wishes to remind the actors concerned of the paramount importance of a fair and impartial environment in terms of conflict resolution and reiterates its commitment to strengthening the rule of law in which the force of law triumphs.
