Haiti - FLASH : The employer sector is alarmed by the arbitrary and illegal methods of the State 29/11/2019 10:41:31
Joint Note : "The undersigned employers' organizations are alarmed by the form taken by the Haitian state of questioning of contracts linking EDH to electricity suppliers. Contracts for the purchase of electrical energy, including that linking Sogener to the Haitian State through EDH, are explicit on how to resolve conflicts if they occur. Respect for contractual agreements is one of the cornerstones of the rule of law in which free enterprise prevails. The non-respect of contracts by the State, the instrumentalization of justice for political ends, public authorities using arbitrary and illegal methods, are unequivocal signals of an authoritarian temptation and an incipient tyranny. Haitian society will not tolerate it and we proclaim, loud and clear, that: THE TIME OF DICTATURES IS REVOLVED ! VIVE A HAITI OF PROGRESS AND TURNED FORWARD ! Deputy Jerry Tardieu (VERTITE) sees the Government's actions as an authoritarian turnaround that will harm the Head of State, saying that instrumentalizing justice to harm his political opponents is dangerous for democracy and a threat to the state by right. Edouard Paultre of the Council of Haitian Non State Actors (CONHANE), believes that the actions of the State and the Prosecutor's Office are likely to lose the State's credibility to develop business in compliance with international standards. Jean-Robert Argant General Coordinator of the Collective December 4, criticizes the Government to use blindly the judicial arm against a private company, instead of appealing to the Chamber of Conciliation and Arbitration of Haiti (CCAH) whose mission is to help find amicable solutions in cases of conflict between the State and one or more private companies As for the Government by the voice of Eddy Jackson Alexis Secretary of State it reacts in a note where it says to regret "[...] that powerful sectors of the society, constituting the oligopoly that controls the economic game, want to continue to become untouchable in the face of Haitian justice. The Government of the Republic condemns an attempt to obstruct justice, in a system in which the strong place themselves above the law, and recalls that the interest of the Haitian people is the only motive for action taken, according to legal channels, in order to solve the problem of energy for the benefit of the Haitian population. In this particular socio-political context, the Government of the Republic calls on everyone to maintain their serenity by thinking of the interest of Haiti."
