Haiti - FLASH : Justice authorizes Trump to end TPS, 58,000 Haitians risk deportation
Monday, the decision (2-1) of the US 9th Circuit Court of Appeals, based in Pasadena, California, ruled that President Donald Trump could terminate the Temporary Protected Status Program (TPS) for 4 countries, quashing the preliminary injunction issued by U.S. District Judge Edward Chen in 2018 https://www.haitilibre.com/en/news-25726-haiti-flash-federal-judge-prevents-trump-administration-to-cancel-tps.html that prevented the US administration from ending the TPS. "The district court abused its discretion in issuing the preliminary injunction," said the three judges of the Court of Appeal.

The decision is also expected to affect more than 200,000 children born in the United States, according to court documents.

This decision of the Court of Appeal leaves a threat of expulsion on some 300,000 Salvadorans, 58,000 Haitians, 5,000 Nicaraguans and 1,000 Sudanese (if they fail to regularize), who were protected by the TPS by which the states -United grants extraordinary permits to citizens of countries affected by armed conflict or natural disasters.

Despite this decision, Trump will not be able to end the TPS for Nicaragua, Sudan and Haiti before March 5, 2021 and November 2021 for El Salvador, says Mr. Ahilan Arulanantham, one of the main advocates of the American Union for Civil Liberties (ACLU).

However, those protected by the TPS and immigrant rights organizations should challenge the ruling, which could potentially be appealed to the United States Supreme Court.

Recall that Nicaragua was included in the TPS program in 1999, El Salvador in 2001, Sudan in 1997 and Haiti in 2010.
