Haiti - FLASH : The decree revoking the CEP would be illegal
The members of the Provisional Electoral Council (CEP) reject out of hand the decree of September 27, 2021 taken by Prime Minister Ariel Henry on September 27, 2021 https://www.haitilibre.com/en/news-34852-haiti-flash-the-government-revokes-the-cep.html The members of the Council, Inform the population that "the alleged decree" taken by the Prime Minister ai Ariel Henry does not "concern them" because it is illegal.

"The decree of September 14, 2020 appointing the members of the said council which is presidential and which must only be revoked by another presidenial decree.

The decree of July 5, 2021, appointing Acting Prime Minister Ariel Henry who, at the end of his prescriptions, orders him to accompany the Provisional Electoral Council in the completion of the electoral process.

Based on these considerations, the members of the Provisional Electoral Council reject this dilatory decision which has nothing to do with the lol and plan, as soon as possible, to seize such bodies, judicial and administrative as of right for the purpose of requesting its annulment."

Reiterating its determination to organize honest, free, credible and democratic elections for the benefit of the Haitian nation.

For its part, the Rassemblement des Jovenelistes pour la Démocratie (RJD), which abounds in the same direction, provides other additional details:

“The decree in question is an decree of the Prime Minister. However, the members of the Provisional Electoral Council are appointed by decree of the President of the Republic, taken by the Council of Ministers. In the event of a presidential vacancy, the powers of the President of the Republic are exercised by the Council of Ministers and not by the Prime Minister"

The decree mentions "on the report of the acting Minister of Justice and Public Security and after deliberation in the Council of Ministers". The RJD underlines that "the signature of the Minister of Justice is not affixed immediately after that of the Prime Minister, which reinforces the observation that the document is not a document of the Council but of the Prime Minister alone."

The RJD goes on to claim that the document published in the Moniteur of September 27, 2021, number 47, entitled "Order freeing the Members of the Provisional Electoral Council from their links with the public administration", is "a forgery in public writing" a crime punishable by law, in particular articles 107 to 110 of the penal code and that the perpetrators and co-perpetrators of this crime must be brought to justice.
