Note that Judge Belabre had already asked the Superior Council of the Judiciary (CSPJ) on February 2 to renew his status as an investigating judge. For its part, the CSPJ referred to article 15 of the 2007 law on the status of magistrates to recall that the request for renewal of the status of a magistrate must be made 6 months before the end of the expiration of his status...

Consequently, more than 9 months after the assassination of President Moïse, the case is on hold pending the appointment of another judge or the renewal of the mandate of Me Belabre...

It should be noted that since his appointment Judge Merlan Belabre has never been able to start his investigation as he points out in an order (which is not a deportation) sent to Me Bernard Saint-Vil, Dean of the Court of First Instance (TPI) of Port-au-Prince and Me Jacques Lafontant Commissioner of the Government of Port-au-Prince, "[...] Whereas the judge cannot begin to investigate since he does not have the physical file and the means allowing him to carry out investigative acts [...] For these reasons, in accordance with the law, we say and declare that there is no reason for the present, for the Investigating Judge Merlan Belabre, to investigate this file, we therefore order the transmission of this letter to the Dean and to the Government Commissioner of this jurisdiction to be done what is right."
