Haiti - FLASH : 6 men sentenced to pay $6.2M in damages to Martine Moïse and her son Joverlein
6 men found guilty in the case of the assassination of Haitian President Jovenel Moïse https://www.haitilibre.com/en/news-34162-haiti-flash-president-jovenel-moise-assassinated-by-mercenaries-official-updated-7am-+-video.html were ordered in the United States to pay damages for the death of President Moïse, to his widow and to his eldest son Joverlein Moïse for a total of $6.2 millions, according to the restitution order issued by Federal Judge José E. Martínez of Miami.

The 6 convicted defendants are : Rodolphe Jaar, a Haitian-Chilean businessman https://www.haitilibre.com/en/news-39685-haiti-flash-rodolphe-jaar-sentenced-to-life-imprisonment-in-the-usa-in-the-assassination-of-president-moise.html ; Joseph Joël John, former Haitian senator https://www.haitilibre.com/en/news-41249-haiti-flash-former-senator-joseph-joel-john-sentenced-to-life-imprisonment-in-the-assassination-of-jovenel-moise.html ; Joseph Vincent, a Haitian-American who worked as an informant for the Drug Enforcement Administration https://www.haitilibre.com/en/news-41640-haiti-assassination-of-the-president-a-4th-accused-sentenced-to-life-in-prison.html ; Germán Alejandro Rivera Garcia, alias "Colonel Mike", a former Colombian military officer who led the commando https://www.haitilibre.com/en/news-40834-haiti-flash-assassination-of-the-president-a-member-of-the-colombian-commando-sentenced-to-life-imprisonment-in-the-usa.html and Mario Antonio Palacios Palacios, a former Colombian soldier recruited by Rivera https://www.haitilibre.com/en/news-41791-haiti-assassination-of-jovenel-moise-mario-palacios-sentenced-to-life-imprisonment.html These people were sentenced to life in prison, but they are cooperating with federal prosecutors and the FBI in the hope to obtain a reduced sentence... A sixth defendant, Frederick Bergmann, was sentenced to nine years in prison for violating federal laws and shipping to Haiti ballistic vests used by the Colombian commandos who carried out the deadly attack on the President.

5 other detainees await trial, they are accused of plotting in South Florida to kill the Haitian President and risk life in prison. They are: Antonio Intriago alias "Tony", Director of a security company in the Miami area, "Counter Terrorist Unit Security" (CTU); Arcángel Pretel Ortiz, a former FBI informant when he joined Intriago; Walter Veintemilla, a Broward County financier; James Solages, a Haitian-American and Sanon who was initially seen by the group as Jovenel Moïse's successor as leader of Haiti.

In the restitution agreement filed last week in Miami federal court, Judge Martinez did not identify the widow and eldest son by name in his final ruling. They are listed as "Victim 1" and "Victim 2". However, Paul Turner, Martine Moïse's lawyer claims that Victim 1 is his client; Others familiar with the matter say President Joverlein's eldest son, Moïse, is victim 2.

Of this sum, Martine Moïse (who currently lives in South Florida) is to receive $5,305,387 while Joverlein Moïse will receive $865,396. However, in reality it remains to be seen how much the widow and eldest son of the President will receive when the we know that only 1 of the 6 condemned owns some property...

Turner said he provided the team of federal prosecutors with receipts for Martine Moïse's medical treatment at Jackson Memorial Hospital as well as other expenses related to her travel and security, characterizing the amount as restitution of “compromise”.

Asked about the challenge of recovering damages Turner acknowledged the difficulty and said he hoped to eventually add other defendants with deeper pockets to the trial...

The judge's order does not specify why the defendants were ordered to compensate Joverlein Moïse who was not present in the house at the time of the assassination.
