Haiti - Justice : Launching of the week of Intellectual Property
As part of the International Day of copyright on April 23, and the World Intellectual Property Day on April 26, the Ministry of Culture, the Haitian Office of Copyright (BHDA) and the Ministry of Commerce and Industry organize, from April 22 to 26, "The week of Intellectual Property" under the theme "your creativity, your wealth".

Monday, Josette Darguste, the Minister of Culture has proceeded to the official opening of this Week of Intellectual Property and delivered a speech for the occasion, in her speech for the occasion, denouncing piracy and plagiarism of intellectual works of several authors "The streets of the capital, whether in terms of pictorial work, music, sculpture or in the filmography field, testify of the violence of piracy and plagiarism of intellectual works of several authors."

On Tuesday, the Minister, accompanied by Ms. Emmelie Prophet, Director General of BHDA, proceeded to the delivery of two scholarships each of an amount of 100,000 Gdes, to two young women lawyers, from the Faculty of Law and Economics, Joanne Grossaint and Madcène Dorcéan, who will write their thesis on Intellectual Property. Both recipients will also benefit from the support of experts on copyright.

Ladies and gentlemen the General Directors
Mr. the Dean's Office Representative of the Faculty of Law
Ladies and Gentlemen,

It is question of copyright, here this afternoon. Copyright is one of two aspects of literary and artistic property. So we are in the field of intellectual property which constitutes the whole of exclusive rights granted on the intellectual creations to the author or to the beneficiaries of the work of the mind.

The intellectual property concept was born with virtually the creation of the World Intellectual Property Organization (WIPO) in 1967. It is, however, documented that the concept took time to settle in the world practice. Haiti, for its part, has joined WIPO in 1983. But it is only recently, with the decree of 12 October 2005 establishing the Haitian Office Copyright (BHDA) that a concrete step has been taken in terms of copyright, although it should be noted that the Haitian law had already examined the issue of copyright in 1864 and 1885 in its financial aspect.

The Haitian Copyright Office, which works since its opening in 2007 under the Ministry of Culture, is invested of a difficult but noble mission. The purpose of BHDA is bi-angle: it is, first, to help the creators of Haitian cultural space to understand that they have rights (many, in fact, ignore) and the encourage them to take initiatives to protect these rights, then comes the hard work to raise awareness on the respect of rights of the author by third parties.

The streets of the capital, whether in terms of pictorial work, music, sculpture or in the filmography field, testify of the violence of piracy and plagiarism of intellectual works of several authors. It is high time for them to get the financial benefits of their work and to fully enjoy the satisfaction that gives the notoriety.

Mechanism conferring protection to creators of literary and artistic of property rights of two types : the patrimonial rights of the extra patrimonial rights on their products, copyright does not put, in fact, sealed on original works. It is a recognition of the rights of creators to set operating limits or use of their works. The good practices will ensure a climate conducive to the creation and development of the capacity of Haitians to innovate. Awareness of Haitians to respect copyright is vital to the creative spirit also, at the international level, will allow to avoid trial because of the improper or unauthorized use of intellectual works of a national or a foreign institution. In the area of new technologies of information and communication technologies (ICTs), we are called to prudence.

The Haitian environment is to date more or less foreign to the issue of copyright. Judicial and legal practices are, with all reserve, almost nonexistent. The Government Martelly-Lamothe is aware and is committed to gives to copyright the needed importance. We pose today one of the bases of the anchor of Haiti in the Culture of copyright. At the Ministry of Culture, today at noon we are happy o make the presentation of two scholarships, 100,000 gourdes each, to two lawyers from the Faculty of Law and Economics, Joanne Grossaint and Madcène Dorcéan, who will write their thesis on Intellectual Property. They will also benefit from the support of experts on issues of copyright.

The day of the copyright is celebrated this year under the theme "Your creativity, your wealth."
Here, training and creativity go together in search of wealth."
