Haiti - Justice : Lawyers of JC Duvalier cons-attack...

Following the decision of the Court of Appeal delivered on 20 February which broke the order of the investigating judge Me Carvès Jean, https://www.haitilibre.com/en/news-4845-haiti-justice-judge-carves-recommends-that-duvalier-is-tried-for-embezzlement-of-public-funds.html Me Reynold Georges, Me Alix Aurélien Jeanty and Me Fritzo Canton, 3 lawyers of former President Jean-Claude Duvalier, said on Tuesday at a press conference, they presented Tuesday, March 11, 2014, to the Court of Cassation, a motion in which they ask for a referral to another court for "grounds of legitimate suspicion" based on the lack of impartiality of the judges of that court, they suspect among others, to be under the influence of the international community.

issued on February 20, which considers the crimes committed under the regime of Jean Claude Duvalier as crimes against humanity. For Me. Reynold Georges, "The judgment of the Court of Appeal has nothing to do with the Haitian criminal law. These are people who want the President Duvalier go to jail by all means, that conspiring with the judges of the Court."
In its intervention Me Frizto Canton launched "Let the judges of the Court of Appeal here told me, what Republic Act deals with the concept of crimes against humanity. That a judge gives me the proof of a Convention on the crime against humanity which was signed and ratified by Haiti and by the Haitian Parliament, which allows him to enter in the domestic legal [...] customary international law [to which it is referred in the judgment, order] has nothing to do with the Haitian criminal law," stating that "Customary international law, so vague it may be, can not replace the internal law of the country."
