Haiti - Politic : President Martelly responded to the President of the Senate
Following the correspondence of President of the Senate, Simon Dieuseul Desras, sent to President Martelly concerning the application of the Agreement El Rancho, the Head of State sent its response. Preferring to ignore the request of the President of the Upper House to reconsider its position on the formation of the Provisional Electoral Council as provided in the agreement El Rancho [reactions already expressed by the Minister of Communication https://www.haitilibre.com/en/news-11036-haiti-politic-the-minister-heriveaux-condemns-the-correspondence-of-senator-desras.html ] the Head of State has preferred to retain the first point of the letter of Senator Desras and remind him the chronology of events that led to the current crisis. Firm but diplomatic, the Head of State recalled "the determination of the Executive to comply to the letter the prescribed of the El Rancho agreement" what officially closes the door to repeated requests from the Senate to form a Provisional Electoral Council based on Article 289 of the Constitution and contrary to the agreement signed.

In this regard, it opposes a categorical denied to certain statements here and elsewhere holding him responsible for delaying the inevitable deadline of 2014. It wishes to point out that the Haitian Nation sighs after the elections since 2011 for local councils and collectivities and since 2012 for the third of the Senate. It is not superfluous to recall, however, all the steps that led to the signing of the agreement El Rancho :

From July 2012, the Judiciary and the Executive Branch designated their representatives to the Permanent Electoral Council. As for the Legislative Power, despite numerous meetings with the Executive, it was unable to appoint its representatives to the council.

On 15 August 2012, the Executive Branch had to install the Permanent Electoral Council with six members, until Parliament comes complete. From that date to December 2012, all the steps taken have never allowed to reach the complete formation of the Council. Finally, in a spirit of compromise, the Executive, within the negotiations under the auspices of "Religions for Peace", accepted the proposed formula by parliamentarians to establish a Transitional College of the Permanent Electoral Council embodied in the agreement of 24 December 2012. https://www.haitilibre.com/en/news-7489-haiti-cep-an-agreement-was-finally-signed-between-the-executive-and-parliament.html

The political situation stayed and remained tense, electionscould not take place in 2013. I then, in order, again, to advance the process, initiated a new series of meetings with political parties, organizations and members of civil society to eventually leading at the El Rancho agreement initialed and signed by the majority of political parties in the country, the Parliament in its two components, organizations and members of civil society, the CSPJ and the Executive, under the auspices this time, of the Haitian Episcopal Conference, whom I thank again for his endless dedication and tact with which she carried out this inter-Haitian political dialogue, a first in the annals of our history.

We are fully into the implementation of Rancho El agreement when I received your letter asking me to return to the Provisional Electoral Council on the basis of an article obsolete of the 1987 Constitution. I also remind you that the El Rancho agreement builds on the spirit of Article 192 of the 1987 Constitution as amended in regard to the formation of the Electoral Council [ Article 192 The Electoral Board comprises nine (9) members chosen from a list of three (3) names submitted by each of the Departmental Assemblies:
3 are chosen by the Executive Branch;
3 are chosen by the Court of Cassation;
3 are chosen by the National Assembly.
The above-mentioned organs ensure, as far as possible that each department is represented.

The problems that seem to concern you such as the Provisional Electoral Council, the electoral law, the climate of trust around the elections have already been taken into account during discussions of the El Rancho agreement whose the Senate was involved.

Travelling for the Summit of Heads of State of the ACS in Mexico, I appeal to your patriotism, your sense of responsibility to lead your peers to break the deadlock by voting the amendments to the electoral law to ensure the holding of elections in October 2014 as planned.

I remain convinced that you will use your expertise to make understand to all those affected by this agreement, that the time has come to implement it, each part that your are concerned.

I take this opportunity to renew to you, Mr. President of the Senate, the expression of my patriotic greetings.
