Haiti - Elections : Ultimate reprieve for the Senators
Following the failure Wednesday of dialogue between the Senate and the Executive, the President Martelly, at the request of the Senate President, Senator Simon Dieuseul Desras, granted an ultimate and small delay to Senators. President of the Senate, wants to try again to convince the opposition senators, member of G6 [Jean-Baptiste Bien-Aîmé (NorthEast), Jean-Charles Moïse (North), Francky Exius (South), Westner Polycarpe (North), John Joël Joseph (West) and Jean William Jeanty (Nippes)], to accept the proposal of Senator Andris Riché, (Vice-President of the Senate) presented on Tuesday and which had then received the support of a majority of senators. https://www.haitilibre.com/en/news-11302-haiti-politic-the-dialogue-between-the-executive-and-the-senate-ends-in-failure.html

Recall that Senator Riché proposed a change of 2 members in the Provisional Electoral Council (a representative of the Superior Council of the Judiciary (CSPJ) and a representative of the Parliament, well as the maintenance of Léopold Berlanger (CSPJ) and Me Néhémy Joseph (Senate) in the Provisional Electoral Council (CEP).

Should be noted for our readers, that the proposal of Senator Riché is entirely consistent with the agreement El Rancho, which stipulates in its Article 7, since 14 March 2014 (date of signature of the Agreement) :

"Institutional framework :
The Parties agree that the Transitional College of the Permanent Electoral Council (CTCEP) be renamed the Provisional Electoral Council (CEP). Each of the three branches of government, namely the Executive, the Legislature and the Judiciary may, after evaluation proceed to the withdrawal of one of its members and provide a replacement within a period not exceeding ten (10) days after the signing of this Agreement. The executive, legislature and judiciary are responsible for the implementation of this Article 7."

Regrding the the maintenance of Léopold Berlanger (CSPJ) and Me Néhémy Joseph (Senate), who refused to take the oath, it is worth remembering that Me Néhémy Joseph (Representative of the Senate), had conditioned his oaths to the confirmation of his position in CEP by the senate, request he made in a letter adressed to the President of the Senate on May 6, letter so far remained unresponded.

In summary nearly 3 months after the El Rancho agreement we are moving possibly on the application of Article 7 which had obtained last Tuesday, the support of a majority of senators subject to members of the G6.

Rosny Desroches, a member of the Monitoring Committee of the Agreement on El Rancho met with senators Thursday, does not wish the President of the Republic calls the people in elections and invokes Article 12 of the Agreement El Rancho, saying that parliamentarians should accept the proposal of Senator Riché.

If by this weekend or at the latest at the beginning of the week, Senator Desras fails to convince members of G6 to make the necessary concessions and to accept the proposal of Senator Riché, to avoid a situation of instability and chaos in the country, the President Martelly, will convene the population in elections and invoke Article 12 concerning the amendments to the electoral law blocked in the Senate :

"IV. SPECIAL PROVISIONS: Article 12: In cases where amendments to the electoral law planned and proposed in the framework of the dialogue are not passed by the two branches of Parliament within the period prescribed in section eight (8) of this Agreement, Parties note with the Provisional Electoral Council (CEP) the physical impossibility of applying Articles referred. Consequently, the Parties agree that the said articles automatically enter into hold and the electoral body is allowed to override. Consequently, the Parties agree that the said articles are automatically in hold and the electoral body is allowed to override."

"As I have always prioritized dialogue, I decided to give a little time to senators, but I will not be afraid to go it alone. There comes a time when we will have to take the road of elections with or without friends," declared he Head of State on the sidelines of the inauguration of the first Centre for Nature Interpretation in Aquin last Thursday.
