Haiti - FLASH : The Kenyan Government appeals the High Court verdict

Isaac Mwaura, Spokesperson for the Kenyan Government, said that the Government had taken note of the verdict of the High Court of Justice prohibiting the deployment in Haiti of 1,000 security agents planned as part of the Multinational Security Support Mission ( MSS) in support of the Haitian National Police in its fight against gangs and for the restoration of public order. "Although the Government respects the rule of law, we have nevertheless decided to immediately challenge the High Court verdict," Mwaura told the media, adding "The Government reiterates its commitment to honor its international obligations as a member of the community and committee of nations [...] Kenya has an exceptional record of contributing to peacekeeping missions at the international level in countries such as : South Sudan, Namibia, Croatia, Liberia, Sierra Leone, among others..."

Let's recall that in a judgment delivered on Friday January 26, 2024, Justice Chacha Mwita declared that the National Security Council did not have the mandate to deploy police officers in another country "[...] any decision taken by a State organ or an agent of the State to deploy police officers in Haiti [...] contravenes the Constitution and the law and is therefore unconstitutional, illegal and invalid. In October last year, Kenya's National Security Council had requested Parliament's approval for the deployment of Kenyan police officers as part of the UN-backed security mission. However, at the same time the Nairobi Kenya High Court after hearing the arguments of Government representatives and opponent Ekuru Aukot, former defeated presidential candidate and Leader of the Third Way Alliance party, at the origin of the complaint against the deployment of the MMSS in October 2023 https://www.haitilibre.com/en/news-40701-haiti-politic-the-high-court-of-kenya-suspends-for-2-weeks-the-deployment-of-the-mission-in-haiti.html , had decided to extend the orders blocking the deployment of police officers in Haiti.

The Kenyan Government intends to exhaust all legal remedies at its disposal to win its case. In the event of failure at the Court of Appeal, only the Supreme Court will remain to decide definitively on the deployment or not of this Mission.

New delays which benefit gangs in Haiti and prolong the suffering of the Haitian population...
