Thursday, November 16, 2023, the Kenyan Parliament (the National Assembly and the Senate) approved the deployment of a thousand police officers in Haiti as part of the Multinational Security Support Mission (MMSS), announced Gladys Shollei, the Deputy Speaker of the Kenyan National Assembly.
Despite the controversy this initiative generated and the temporary blockade ordered in October by the Nairobi High Court following a complaint from opponent and former presidential candidate Ekuru Aukot who declared "Our parliamentarians are disobeying a court decision [...] Our Parliament sold its soul to the United States, which wants to clean up the disaster they caused in Haiti" to which Shollei responded that the deputies of the National Assembly had not disobeyed because he had not never received the judicial request from the Nairobi High Court ordering last month the temporary blocking of the deployment of the Kenyan Police in Haiti...
The vote was also opposed by several opposition MPs, but the ruling coalition of President William Ruto, which has a majority in the National Assembly, was not disturbed.
But, at the same time, the High Court of Nairobi Kenya after hearing the arguments of representatives of the Government and the opponent Ekuru Aukot decided to extend the orders blocking the deployment of police officers in Haiti, even though Parliament had just approve the deployment of 1,000 police officers to Haiti. High Court Justice Chacha Mwita, said he would deliver a decision on January 26, 2024.
The plaintiffs argue that Kenya's Constitution limits police deployment to operations within the country and that only members of the Kenya Defense Forces can be deployed outside the country.
Government lawyer Eric Gumbo explained that Kenya, having ratified the United Nations charter in 1963, was obliged to support the Peace initiative, recalling that the decision to deploy police officers in a foreign country will be determined by Constitutional bodies.
Should be noted that whatever the High Court decides in January 2024, it may be appealed, meaning there could be a prolonged battle over sending troops to Haiti...
