Recall that the vote followed the report of the Senate Committee responsible for investigating the circumstances surrounding the death of Judge Jean Serge Joseph, died of a stroke Saturday, July 13, 2013. The vote was delivered by 7 votes and 9 abstentions, despite interventions by Senators Jean-Willy Jean-Baptiste, François Lucas St-Vil, Hyppolite Mélius and Edwin Daniel Zenny, who constantly reminded that the Commission was illegal, since it did not take into account the political sensitivities of the Senate because composed exclusively of members of the opposition, saying that the report was assembled from scratch in the sole purpose of push the country into political instability. Edwin Daniel Zenny left the meeting before the vote and that the Senators Wenceslass Lambert, Maxime Roumer and Dereix Pierre-Louis, were absent.

Note that the Senators François Annick Joseph , Westner Polycarpe, John Joël Joseph, Steven Irvenson Benoît and Francky Exius who voted for the impeachment, are both judge and jury, as they were members of the Commission and signed the report. At these 5 votes were added that of Senator Jean-Charles Moïse, personal fierce opponent of President Martelly and that of Senator Jean-Baptiste Bien-Aîmé.

It was now up to the Lower House, where President Martelly has a large majority, to decide the result of the impeachment. Recall that according to the Constitution, it is necessary to have a vote of two thirds of members to allow the Senate to erect in high Court of Justice and possibly dismiss, the Head of State, Prime Minister and Minister of Justice, which is unlikely. Given the balance of power to the Lower House, it seems that this symbolic vote of Senate, aims to further embarrass the government and feed the crisis and strengthen the anti-government opposition.
