Haiti - FLASH : FIFA is appealing the CAS decision canceling the sanctions against Yves Jean-Bart

Earlier this week, FIFA announced that it had filed an appeal with the federal judges of the Swiss Supreme Court to challenge the decision of the Court of Arbitration for Sport (CAS) https://www.haitilibre.com/en/news-38856-haiti-flash-the-court-of-arbitration-for-sport-cancels-the-sanctions-against-yves-jean-bart.html to cancel the life suspension of the former President of the Haitian Federation of Football (FHF) Yves Jean-Bart alias "Dadou" of all sports activities https://www.haitilibre.com/en/news-32340-haiti-flash-yves-jean-bart-banned-for-life-from-football-by-fifa.html , accused of multiple sexual offenses against female national team players at the FIFA Goal center in Croix-des-Bouquets in Haiti.
"FIFA is concerned that this decision (CAS) contains a number of very serious procedural and substantive flaws, including the failure of the CAS panel to assess the key evidence offered by FIFA."
FIFA said it asked the Swiss Federal Court to overturn the CAS verdict and send the case back for a second hearing.
Note that the Federal Court can review CAS decisions on limited grounds such as abuse of process but rarely overturns verdicts.
The decision released by FIFA on November 18, 2020, detailed how ethics judges believed allegations that, for 20 years as President of the Haitian federation, Jean-Bart raped underage girls and habitually sex with players.

When Jean-Bart's appeal came to CAS a year ago, his legal team provided 21 witnesses who testified on his behalf. FIFA produced a witness "as a victim of the actions of Yves Jean-Bart", the CAS said of its verdict.
Witnesses in Haiti have reportedly been threatened not to testify against Jean-Bart. The CAS said its three-judge panel was "fully aware of the seriousness of the facts alleged and the possibility that certain witnesses felt threatened [...] It took all possible measures to facilitate the search for evidence and the establishment facts," the court said, including the ability to testify accompanied by a CAS representative from an undisclosed location through encrypted calls with distorted voices to protect the identity of the witness.

According to Romain Molina, Jean Bart is asking for more than 50,000 euros for defamation "He is asking for the publication of rights of reply or others in articles in Le Nouvelliste, L'Equipe and Le Monde... up to 5,000 euros per article", said the journalist. In addition, Jean Bart is claiming reimbursement of the costs he paid to obtain the services of his lawyers, i.e. 17 thousand euros...
