Haiti - State against SOGENER : The Public Prosecutor launches a wave of invitations for hearings
Following the complaint lodged on November 8 by the Government https://www.haitilibre.com/en/news-29242-haiti-justice-the-haitian-state-complains-against-sogener-and-other-personalities.html against the company producing electricity Société Générale d'Energie S.A. (SOGENER) requesting the setting in motion of the public action against the SOGENER and several people related in particular for presumptions of corruption by overcharging, for purposes enrichment to the detriment of the State, Me Jacques Lafontant, acting Commissioner of Government at the Court of First Instance of Port-au-Prince, sent November 14, 2019 a wave of invitations to several people related in this case.

Me Jacques Lafontant, invites to attend the Procuratorate of Port-au-Prince on Thursday, November 21, 2019 at 10:00 am: former ministers Frantz Vérella and Daniel Dorsainvil, Serge Raphael former director of the EDH, Élizabeth Débrosse Préval, shareholder in SOGENER and Jean Marie Vorbe, Dimitri Vorbe, Réginald Vorbe Fils and the lawyer Roger Lefèvre, members of SOGENER's Board of Directors "[...] to answer for factspf fake and use of forgery in private writing, overcharging, illicit enrichment, criminal conspiracy and breach of trust; following the complaint of the Haitian State, filed on November 8, 2019, to the prosecutor's office of that jurisdiction, the body responsible for criminal prosecution [...]" stipulates the invitation of the State Commissioner of the Government.

In addition, Md Lafontant asked the Governor of the Bank of the Republic of Haiti (BRH), Jean Baden Dubois, to send him, as soon as possible, all the documents attesting to the State's payments from the public treasury to the benefit of the SOGENER from 2006 to the present day. A similar request was made to Joseph Jouthe, the Minister of the Economy and Finance.

Commissioner Lafontant stresses that these people are defendants, invited in a hearing phase because of presumptions that could be requalified according to the hearings.

Note that the day before the sending of these invitations, Jean Marie Vorbe Chairman and CEO of SOGENER had sent a correspondence to the Minister of Works and the Minister of the Economy and Finance due to the lack of follow-up of the meeting of September 17, 2019...

I have the honor to remind you that Société Générale d'Energie S.A. (SOGENER) responded to your invitation to the meeting of October 22, 2019, made by letter dated September 17, 2019 and signed jointly by the Minister of Public Works , Transport and Communications and the Minister of Economy and Finance.

At the end of the discussions, it was agreed that the minutes of the meeting of Tuesday 22 October 2019 and the report of the Steering Committee on Energy Sector Reform will be communicated to SOGENER in accordance with the principle contradictory. As a result, a new date was to be set for further discussions on the basis of that report and other points. But until today no report, no report and no new invitation have been notified to SOGENER.

I request a meeting with you, with the participation of the Director General of EDH in order to follow up the conclusions of the meeting of 22 October 2019 and also to find an amicable solution in execution of article 23.1 of the contract binding the Haitian State , the Electricity of Haiti to SOGENER, thus stipulated : 'In case of dispute, the two parties will try to find an amicable solution within thirty days following a notification of one or the other parts'.
