Haiti - FLASH : The State retakes possession of the power plants managed by the SOGENER 23/11/2019 07:42:25
The acting Commissioner of Government, of Port-au-Prince, near the Court of First Instance Me Jacques Lafontant, in a correspondence dated Thursday, November 21, 2019, addressed to the West Departmental Directorate of the National Police of Haiti (PNH) asks the police to accompany the justice of the peace of the commune of Cité Soleil to retakes possession of the sites of Sogener de Varreux 1 and 2 on behalf of Electricité D'Haïti. Letter from the acting Government Commissioner : "the 21/11/2019 The Government Commissioner at the Court of First Instance of this jurisdiction, Requires the heads of the Departmental Directorate of the Western Police (DDO) to make all the arrangements required by the circumstances to assist the Justice of the Peace of the Municipality of the Cité Soleil or one of his deputy, and to accompany the Representatives of the State and Electricity of Haiti (EDH), as well as the usher Ulrick Félix, registered at the registry of the court of this jurisdiction, for the purpose of the recovery by the State, on behalf of the EDH, of the possession and full enjoyment of its Sites and its Power Plants in said Commune in Varreux, in accordance with the order of the Dean of the Court of First Instance of Port-au-Prince dated today twenty-five and one (21) November two thousand and nineteen (2019). Police officers and the Judge of Peace , in the event of resistance or obstruction of the execution of this order and this requisition, in any form whatsoever, will proceed, as it is said in cases of flagrancy in the taking of the body of the offenders; the judge of peace shall draw up such minutes and shall forward the said defendants to the public prosecutor's office, in order to do what is right, in accordance with the law and procedure of that." It was the judge of Peace of Cité Soleil, Julien Vertu who was at the head of this operation which took place in the presence of the technicians of the EDH, to draw up a report and facilitate the recovery of the space according to the order of the Chief Prosecutor.
