Haiti - FLASH : The supplementary indictment accusing the PM has mysteriously disappeared
On Wednesday at a press conference Me Renan Hédouville, Citizen Protector of the OPC ,National Independent State Institution for the promotion and protection of human rights reiterated that the Prime Minister, Ariel Henry, constitutes a major obstacle in the pursuit of the investigation into the assassination of President Jovenel Moïse by a commando of foreign mercenaries helped in their dirty work by several Haitians.

He recalled in a document dated the same day that as part of the investigation into this crime, "[...] more than forty people have already been arrested by the National Police of Haiti (PNH). Other individuals from different sectors (political, religious, legal, commercial) cited in this file and prosecuted by the Police are on the run" citing as an example "Wendelle Coq Thélot, John Joël Joseph, Félix Badio, Gérald Bataille, Paul Denis, Gérard Forges Janvier, Samir Handall..."

He considers that one of the major obstacles to the investigation which should lead to the trial of all the alleged assassins (sponsors, intellectual authors and material authors) is and remains the de facto Prime Minister, Dr Ariel Henry, considered to be one of the main suspects in connection with the assassination of President Moïse, citing a series of charges

a) On August 4, 2021, during a radio and television broadcast on Scoop FM, Prime Minister Ariel Henry, responding to a question from star journalist Gary Pierre Paul Charles on the dossier of the assassination of President Jovenel Moïse, a declared that Joseph Félix Badio (one of the alleged assassins cited in this file) cannot commit such a crime...

b) In the meantime, information conveyed led to believe that the de facto Prime Minister, Dr Ariel Henry and Joseph Félix Badio were in contact before and after the assassination of the Head of State.

c) The Prime Minister's Communication Office rejected these allegations because, claiming that the Prime Minister never spoke with Joseph Félix Badio.

4. The revelations of the Digiciel company confirming the contacts between Ariel Henry and Joseph Félix Badio [...] Information made public by Digicel and relayed by the press confirms that, "shortly after the assassination of President Jovenel Moïse, ie on the 7th July 2021, Ariel Henry and Joseph Félix Badio had a 3-minute telephone conversation around 4:03 am According to GPS data, Ariel Henry was located in Montana and Badio in Pèlerin, at the scene of the crime. 17 minutes later, at 4:20 am, the two men spoke for 4 minutes."

The Government Commissioner, in order to clarify these suspicious revelations, invited Prime Minister Ariel Henry, to the Public Prosecutor's Office on Tuesday, September 14, 2021, in order to verify the content of the aforementioned conversations for a possible additional indictment to be sent to the Judge in charge of the investigation in this case https://www.haitilibre.com/en/news-34762-haiti-justice-phone-call-with-badio-the-pm-does-not-remember.html

In particular trampling on the principle that "no one is above the law", the Prime Minister refused to provide explanations to the Government Commissioner and shunned the invitation of the Chief Prosecutor.

Displaying fascist behavior, he dismissed the Government Commissioner on September 13, 2021, then the Minister of Justice, Me Rockefeller Vincent, to replace them with men in his pay with the idea of hiding the truth."

Adding that "The supplementary indictment prepared by Commissioner Bed Ford Claude, requesting the indictment of Prime Minister Ariel Henry, has disappeared or has been removed from the file https://www.haitilibre.com/article-34746-haiti-flash -the-Prime-Minister-threat-of-indictment-and-forbidden-to-leave-the-territory.html »

Stressing "before his arbitrary dismissal by the Prime Minister indexed, Commissioner Bed Ford Claude had time to transfer to the dean of the Court of First Instance the supplementary indictment requesting the indictment of Prime Minister Ariel Henry to be sent to the office of the Judge Instructor, Me Gary Orélien. However, this correspondence bearing the number 0635-09/20-21, dated September 14, 2021 notification of receipt, is not at the seat of Judge Instructor Gary Orélien. It also disappeared in a mysterious way."

Me Renan Hédouville also criticizes the complacent attitude of a fringe of the international community "[...] which supports a Prime Minister decried and indexed in the assassination of President Jovenel Moïse [...] By supporting the unbearable, part of the international community hhttps://www.haitilibre.com/en/news-34260-haiti-flash-turnaround-of-core-group-in-favor-of-the-pm-named-ariel-henry.html implicitly encourages the Prime Minister in fact, Ariel Henry in his attempts to further weaken the investigation into the assassination of President Jovenel Moïse exposed to major challenges.

Based on these findings, the OPC, "renews its request to the UN Special Investigation Commission to support Judge Gary Orélien in charge of the case and recommends that the international community avoid becoming an accomplice of Prime Minister Ariel Henry."
