Haiti - FLASH Sogener : State lawyers demand the disqualification of all judges of the TPI of Port-au-Prince

Monday, following the appeal of the Société Générale d'Energie S.A. (SOGENER) lawyers to the Dean Me Bernard Saint-Vil of the Court of First Instance (TPI) of Port-au-Prince to cancel the orders to bring issued including against the shareholders of the company https://www.haitilibre.com/en/news-29390-haiti-news-zapping.html 7 Sogener's lawyers appeared before the Dean for this new episode of the judicial Saga "State against Sogener".
Government lawyers, having learned of the attempt to lift arrest warrants against Sogener officials, filed a petition for disqualification of all the judges of the TPI because of legitimate suspicion, in order to prevent Sogener's lawyers to break the decisions of the Public Prosecutor's Office https://www.haitilibre.com/en/news-29381-haiti-flash-the-prosecutor-s-office-issues-warrants-to-bring-in-the-case-state-against-sogener.html
One of Sogener's lawyers has referred to Article 453 of the Code of Civil Procedure to request the Dean of the TPI to reject the State's request for mass disqualification.
After hearing both parties, Bernard Saint-Vil declared himself incompetent to rule on the admissibility or the inadmissibility of the application for mass disqualification of all the judges of the TPI, as requested by the State lawyers. He decided to stay the request of Sogener's lawyers and to defer the case to the Court of Cassation, which will decide in the next episode.
