Haiti - Assassination of the President : Legal tracks and perspectives

Economic tracks :
President Moïse has waged a head-on battle against traditional families with a monopoly on important and strategic areas, including energy. Through the Bureau de Monétisation des Programs d'Aide au Développement (BNPAD), he took control of the oil sector from those who had "placed" him in power (from the Ruby group to West Indies Petroleum).
Smugglers' tracks :
The investigation should also explore the transnational crime in which his entourage is involved : drug trafficking, arms and other trafficking, grand corruption, money laundering... The President was reportedly about to deliver to the American Government a list of political leaders and businessmen linked to drug trafficking (source New York Times).
Political Track :
Jovenel Moïse absolutely had to hand over power to the PHTK. However, he severed his ties with his party. The betrayal is not only economic, it is also political.
Haitian justice and perspectives:
Haitian justice, dysfunctional in fact and in law, cannot carry out the trial of the assassination of President Moïse, Haitian law is not adapted to the nature of this crime. The constraints are procedural, political, environmental... The institution of a special court (hybrid court for example) should be explored if we really want to carry out this trial, otherwise it will remain rhetoric : cascading withdrawal of judges for reasons of security and lack of means, insufficient instruction time, denunciations in the media, the investigation continues… concluded the Cardh in its summary.

The death Wednesday November 17, 2021, of the former police officer Gilbert Dragon, suspected of complicity in the assassination of Haitian President Jovenel Moïse, who was detained at the national penitentiary, would have died according to the National Police of Haiti of complications due to Covid-19. An explanation that did not convince the former First Lady Martine Moïse who qualifies as suspect the circumstances of the death of an individual whose name is cited 47 times in the investigation file...
In a correspondence dated November 17 to the Government Commissioner of Port-au-Prince, Martine Moïse via his law firm emphasizes that an investigation should be carried out to find out the source of the contamination in the national penitentiary by the Covid- 19, taking into account that the inmates have no direct contact with people outside and that no other case has been officially reported in this penitentiary.
"Regarding a violent death, or a death whose cause would be unknown, suspect, the code of criminal investigation, in its article 34 provides that you are required to be assisted by one or two doctors, surgeons, or health officer, who will make their reports on the causes of death and on the state of the corpse," said his lawyers to the Government Commissioner who asked for this purpose that an autopsy of the corpse of Gilbert Dragon be carried out.
