Haiti - SAGA : SOGENER S.A. denounces the politico-judicial persecution of the State 11/08/2020 11:32:17
Note from SOGENER S.A. : "Société Générale d'Energie S.A. (SOGENER S.A.) wishes, once again, to draw the attention of the general public to the serious infringements of rights and freedoms including the company, members of the VORBE family and Agnès Elizabeth Débrosse Préval continued to be victims of the Moïse-Jouthe administration. The execution of a commercial contract, binding the Haitian commercial company, SOGENER S.A. to the Haitian state, served as a pretext for an instrumentalisation of the judiciary. The President of the Republic, Mr. Jovenel Moïse, hardly conceives that a Haitian citizen, member of the Vorbe family, can, in the exercise of his civil and political rights (constitutional and fundamental), express ideas contrary to his own by relation to its conception and management of the State. Indeed, the Moïse-Lapin and Moïse-Jouthe administrations, under the watchful eye of the President of the Republic, since October 2019, have improperly mobilized all State institutions in the exercise of public power against the leaders of this commercial company, members of their family and Agnès Elizabeth Débrosse Préval. Thus, they use the judicial system to lead an all-out campaign of political persecution by setting up mechanisms to violate fundamental rights and freedoms, including access to justice, the right to property and to individual liberty. As evidenced by, among others, the warrants issued by the government commissioner in defiance of the principle of the separation of repressive functions, the constitution of lawyers from outside the regular staff of the Directorate General of Taxes (DGI), representative of the State in court, the political and irregular use of specialized units of the Haitian National Police in the execution of arrest warrants inoperative due to a judicial decision of suspension of the Dean of the court of first instance of Port-au-Prince and house searches, as well as the regulated cutting of the deanery of the Court of First Instance of Port-au-Prince by the executive for the production of illegal judicial decisions known in advance and on non-legal reasons, the arbitrary adoption of measures prohibiting departure, etc. Since then, the Vorbe family and the directors of SOGENER S.A. have been the subject of a very long and intensive media lynching campaign through traditional media and social networks, by individuals employed by the Executive but deprived of quality rights of State attorneys. The alleged case, finally transmitted to the Dean of the Court of First Instance of Port-au-Prince, was entrusted to an investigating magistrate for the opening of a judicial investigation. As part of the search for judicial truth, the chief executive officer (CEO) of the company was invited on January 30, 2020 by the examining magistrate for questioning. At the end of this interrogation of approximately four (4) hours of time, the investigating magistrate, precisely convinced of the inexistence of serious clues in support of such serious accusations, authorized him to return to his home and to remain at his disposal for the continuation of the instruction. While the case is still pending in the cabinet of instruction and another case, qualified as an offense, at the Court of Appeal, another investigating judge, for the same facts and between the same parties, curiously put the property of SOGENER S.A. and the homes of all its leaders and family members under "police security control", a measure that does not exist in Haitian law, based on a protective order without having previously questioned the accused persons. We remind you that SOGENER S.A. is a public limited company, that is to say a capital company with limited liability, whose members are protected by the status of anonymity which protects them from any direct legal action. As a reminder, it is important to mention that SOGENER S.A. s not the property of the VORBE family, although some of its members are shareholders. The government's harassment on the family becomes even more blatant and unfair when it attacks members who have nothing to do with the company, other than support, union, and proverbial solidarity and legendary VORBE between them. Nothing to justify such actions, if it is not this will, of Mr. Jovenel Moïse abusing his status of all powerful President of the Republic to persecute honest and respectful entrepreneurs who, after many years of hard work and at the cost of heavy sacrifices, built a reputation in this country of theirs.
